General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed via the MS Parts online shop (www.msparts.ch) as well as orders via direct message (Instagram, WhatsApp, or email).
By placing an order, you accept these GTC in their currently valid version.
2. Offer and Conclusion of Contract
- The presentation of products in the online shop or on social media does not constitute a legally binding offer.
- A contract is concluded as soon as we confirm your order by email or message or the goods are shipped.
- Customer-configured products (e.g., steering wheels, special colors, special materials, Maxton products) are binding and cannot be canceled or changed after the order has been placed.
3. Prices and VAT
- All prices are in Swiss francs (CHF).
- MS Parts is currently not subject to VAT (according to a sales threshold of CHF 100,000).
- Shipping costs are shown separately during the ordering process.
- Price changes, errors, and misprints are reserved.
4. Payment Methods
The following payment methods are available:
- Twint
- Credit card (Visa, MasterCard, Amex)
- Klarna (purchase on account / installment, if available)
- Prepayment (bank transfer)
MS Parts reserves the right to refuse orders without giving reasons.
5. Retention of Title
The delivered goods remain the property of MS Parts until full payment is received.
In the event of late payment, we reserve the right to charge reminder fees, collection costs, and take legal action.
6. Delivery and Shipping
- Deliveries are made exclusively within Switzerland.
- Standard stock items (e.g., Velcro license plate holders): Delivery time 3–7 business days.
- Custom products (e.g., steering wheels): approx. 20–30 days.
- Maxton Design products: are produced exclusively to order, delivery time 45–60 days.
- Delivery times are non-binding. Delays at the manufacturer, customs, or transport do not constitute grounds for claims for damages.
- Partial deliveries are permitted and do not incur additional costs.
7. Transfer of Risk & Transport Damage
- The risk is transferred to you upon handover to the shipping company.
- Transport damage or obvious defects must be reported to the shipping company and us within 5 days.
- In the event of non-collection or incorrect address information, the customer shall bear all subsequent costs.
8. Returns & Cancellations
- There is no right of return or cancellation for customized products (e.g., steering wheels, Maxton products, custom-made items).
- Cancellation after order confirmation is excluded.
- For stock items (e.g., Velcro license plate holders), we voluntarily grant a 7-day right of return, provided the goods are returned unopened, unused, and in their original packaging. Return shipping costs are borne by the customer.
- Returns without prior confirmation will not be accepted.
9. Warranty & Guarantee
- Steering wheels & custom-made products: Warranty applies exclusively to the stitching, 12 months from delivery. Wear and tear, leather, Alcantara, carbon fiber parts, electronics, or assembly errors are excluded.
- Maxton products: No warranty beyond the statutory minimum; responsibility for fit, paintwork, or registration lies with the customer.
- B2C customers: Legal warranty of 2 years, unless excluded by the above restrictions.
- B2B customers: Warranty for a maximum of 12 months.
- Any warranty is void in the event of improper installation, misuse, or modifications by the customer.
10. Liability
- MS Parts is not liable for consequential damages, loss of use, or costs resulting from installation, painting, or expert opinions.
- Installation must be carried out by qualified personnel. Damage resulting from faulty or private installation is excluded.
- Liability for minor negligence is excluded; personal injury or gross negligence remains unaffected.
11. Road Legal
- Many tuning parts (e.g., Maxton aerodynamic parts) are not automatically road legal.
- The customer is obligated to obtain information from the Road Traffic Office (STVA) regarding approval and any required reports.
- MS Parts assumes no responsibility for the eligibility or successful registration of products.
12. Data Protection
- Your data will be used exclusively for order processing.
- Disclosure will only occur with shipping or payment service providers.
- The Swiss Data Protection Act (DSG) and – where applicable – the GDPR apply.
13. Place of Jurisdiction & Applicable Law
Swiss law applies exclusively.
The place of jurisdiction is 5018 Erlinsbach AG, unless a mandatory statutory place of jurisdiction applies.
14. Severability Clause
Should any provision of these Terms and Conditions be invalid or ineffective, the validity of the remaining provisions shall remain unaffected.
